  • Gymnastics NSW is committed to ensuring that the sport is safe, free from harassment, and that Members and Gymnastics NSW are accountable for the decisions they make. We expect Members and personnel to ensure that they at all times exhibit the highest level of personal conduct and that decisions are made fairly, consistently and consistent with our objectives. If you believe that Gymnastics NSW or one of our Members have engaged in conduct, or made a decision, that falls below this high expectation please complete this online questionnaire:

     

    Clause 9.1           Eligibility

     

    9.1.1      A Member who has a grievance may only lodge a formal grievance at Stage 2 of the process on one or more of the following grounds;

     

    a.       failure to properly apply a GNSW and/or Gymnastics Australia policy, bylaw, or assessment criteria, or implement a selection process;

    b.      misconduct that is not heard under the Discipline Policy;

    c.       matters referred to be heard under the Grievance Policy by the CEO in his/her absolute discretion;

    d.      administrative error; or

    e.       failure to provide natural justice.

    • When resolving grievances it assists the investigation if you are willing to disclose your identity to the other party. We will disclose your contact details to the other party unless you request otherwise.

      (Clause 6.6: The confidentiality of parties involved in a grievance shall be respected at all times, subject to the need to fully investigate the matter and any legal requirements for disclosure).

    • To ensure fairness Gymnastics NSW must be able to provide the other party with the details of the complaint and they must be provided with an opportunity to respond. If you are unwilling to share your complaint with the other party Gymnastics NSW is unable to assist.

       

      (Clause 6.5: The principles of natural justice shall be observed. To this end the parties involved in a grievance have a right to a fair hearing and to have a decision made by an unbiased decision maker)

    • (Clause 8 – Stage 1 Informal Resolutions: A Member, or Committee who has a question, concern or complaint about a decision, act or omission that affects them, should first approach the person(s) and/or Committee directly involved to discuss the matter. They may then seek advice informally from other appropriate persons in the Association).
