    Donation Club Membership - Standard Terms & Conditions

    1.     All Donation Club Members (“DCM”) will have the option to join the ASF (“Australian sports foundation”), unless your club, organisation or entity, already has a charity status or association with another charity foundation

    2.     DCM recognise that the Australian sports foundation will retain 5% of donations as specified in the DCM agreement with the Australian sports foundation to all clubs that join their membership.

    3.     DCM agree to the placement of an Athletes Gel (“AG”) icon on their homepage so that donations generated through sales of AG products by the DCM can be identified by the Australian sports foundation.

    4.     DCM accepts and agrees that AG may use their name or club logo, for the benefit of the DCM or for attracting new DCMs. AG grants the DCM a limited, non-exclusive, royalty-free right to use any name, logos, and/or marks provided to the DCM by AG for the generation of donations.  

    5.     AG shall indemnify, defend, and hold harmless the DCM from and against any and all liability, loss or damage (including injury, death, or damage to person and/or property) directly or indirectly associated with any claims, demands, actions, causes of action, judgments, costs, expenses and/or fees (“Claims”) that result from, arise out of, or relate to the provision the Products of AG however to the maximum extent permitted by law, in no event will AG be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising out of or that relate in any way to DCM membership activities. 

    6.     AG accepts no liability for acts carried out by any person using personal login information, and you indemnify AG from any costs, expenses or damages paid or payable by AG in connection with any such misuse.

    7.     DCM understand and agree that they must not provide AG with any gift, prize, or incentive in connection with the making of donations. 

    8.     If a DCM notices any content posted in breach of these Terms or that the user considers offensive or unlawful, this should be notified to AG at email addressinfo@athletegel.com.

    9.   AG cannot and does not guarantee continuous operation of the website or the integrity of the data stored or transmitted in or through its website.

    10.   AG is under no obligation to approach or appoint a potential DCM or AG ambassador suggested or nominated by them.
