Family Photography Agreement

TERMS & CONDITIONS

Please read the terms and conditions carefully. Tick the box to confirm that you have read them.

1. Entire Agreement*

This agreement contains the entire understanding between Photographed with Love (Mariam Mohd Johari) and the Client listed in this agreement. It supersedes all prior and/or any other verbal or other agreements between the parties. Additions or alterations to this agreement will only be recognised if in writing and signed by both parties.

2. Booking and Payment*

Upon receiving the written confirmation and the required deposit, Photographed with Love will reserve the time(s) and date(s) agreed upon, and will not make any other reservations for the period. For this reason, the booking deposit is non refundable for any reason what so ever. The booking deposit is to be paid at the time of signing the contract. The booking deposit is applied towards the agreed family photography package. The Client understands and agrees that the total amount owed for the family photography package described in the contract is due on the day the photography services is conducted. Should a delay occur with final payment, the event will be photographed and all photography will be held until two weeks after payment has cleared.

3. Service Guarantee*

Photographed with Love guarantees its services up to but not to exceed the photographic fees paid by the client to Photographed with Love. Services include the digital photographing of the above event by Photographer (Mariam Mohd Johari) at the above speciﬁed time and place for the above amount of time with the use of Mariam as the principal photographer. If Client would like to have additional hour(s) on the day itself, Client will pay additional $395/per hour for the extra time and photographs taken.

4. Photography Styling*

The Client understands that the quantity of photographs taken at the event can vary greatly and that photography by nature is an art, subject to the creativity of the photographer and her personal artistic style. The Client understands that he/she has chosen the photographer because of her photographic style, and will grant the photographer the right to exercise her creativity in the interest of creating the best images possible. The client understands he/she may not demand a refund, or a redo due to differences in artistic preferences of the final images.

5. Delivery*

Photos will be available for viewing within 5 business days after the event that will be made available via an online gallery.

6. Photo Policy*

Client agrees that unedited photos will not be shared for any reason. Only your retouched/edited photos will be released. If Client would like to purchase additional photos, the Client may do so. All outtakes and unedited photos are the property of Photographed with Love and are not to be shared, distributed or posted under any circumstances.

7. Model Release*

I hereby give to Mariam Mohd Johari of Photographed With Love the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself, partner and/or my minor child in which he/she may be included in Photographed with Love publications in any medium for marketing and promotional uses.

8. Copyright*

All photography copyright © by Photographed with Love is protected by Australian Copyright Law (all rights reserved). The Photographer own and retains copyright of all images created. The Client authorises Photographed with Love to use the images, make reproductions and publish images for promotional or advertising material or for use on the Photographer’s website(s) or Instagram page or other social network sites. Unless otherwise agreed between the parties, the Client waives all rights to review and approve any uses of the images or accompanying captions. If the Client wishes to contract out of authorising Photographed with Love to use the images, the Client must have a discussion with the Photographer about this upon signing this agreement before any photography takes place.

9. Client Usage Rights*

The Client has unlimited but non-exclusive rights to use or reproduce the images provided to the Client by Photographed with Love. Said images may not be altered or reproduced in any manner that compromises the integrity of the work. The digital images and digital files are the property of the Client for the personal use and for the purposes of distribution of photographs to friends and relatives. Image files are non-transferable and cannot be given, shared, or sold to any third party. If the Client posts the images on Facebook or on any social media platform, the Photographer would very much appreciate any referrals or links back to the Photographer’s website or Instagram page. Commercial use is strictly prohibited.

10. Cancellation*

In the event that the Client cancels the contracted services for the family photography outlined in this contract before the photoshoot takes place for any reason, the deposit will be forfeited.

11. Limit of Liability*

In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Photographed with Love will make every effort to secure replacement photographer able and/or willing to provide similar package as chosen in this contract. If such situation should occur and suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer. The Photographer makes every effort to keep any of the above from happening. No specific photograph is guaranteed.
