This Agreement is made between Esequiel "Zeke" Rivera and Associates (Independent Contractor) and you and your significant other. You and your significant other will be known in this contract as Couple. This is for the purpose of retaining a Notary Public to notarize an Affidavit and a Wedding Officiant to perform a wedding ceremony on the Couple’s behalf.
Esequiel "Zeke" Rivera agrees to provide services to Couple starting on the date when this contract is signed.
Location of Wedding: Lerdo County Jail, in the County of Kern.
$400.00: Total Fee must be paid up front and in full to conduct both Notary Services and conduct the Wedding Ceremony.
There is a separate fee of $101.00 to purchase the Wedding License from the Kern County Clerk Office, when you meet with the Wedding Officiant. (Fee May Change Without Notice)
$200.00: This Fee is for Zekes Mobile Notary Services and Traveling Fee to meet with the inmate at Lerdo County Jail. Fee must be paid up front: if for any reason if notary services do not occur; including the inmate refuses to meet with me or he was Transferred Out, Out to Court, Out to Medical; appointment will be considered a "no show".

$200.00: This Fee is paid to the Wedding Officiant (Independent Contractor) who will meet with you at the County Clerk’s Office and conduct the Wedding Ceremony for said couple. The Wedding Officiant (Independent Contractor) will contact you and confirm a date and time and make arrangements for the time and date to meet at the County Clerk Office in order to get the wedding license. The Wedding Officiant (Independent Contractor) will be available for the Couples’ wedding date and time; thus preventing the Wedding Officiant (Independent Contractor) from booking another wedding at the same time. If for any reason, a decision is made not to use the services of Esequiel "Zeke" Rivera and Associates (Independent Contractor), the Couple must inform Esequiel "Zeke" Rivera and Associates (Independent Contractor), in writing (e-mail or letter) 5 days prior to the wedding date in order to release the Couple from this contract. If the Couple fails to provide such notice, the Couple agrees to be responsible for the remainder of the balance owed to the Wedding Officiant. The Couple and Esequiel "Zeke" Rivera and Associates (Independent Contractor) agree to act in good faith towards one another and to communicate openly and honestly during the length of this contract.
WARRANTY: Esequiel "Zeke" Rivera and Associates (Independent Contractor) shall provide its services and meet its obligations under this Contract in a timely and workmanlike manner, using knowledge and recommendations for performing the services which meet generally acceptable standards in community and region, and will provide a standard of care equal to, or superior to, care used by service providers similar to Esequiel "Zeke" Rivera and Associates (Independent Contractor) on similar projects. Esequiel "Zeke" Rivera and Associates (Independent Contractor) agrees to be available in assistance with the Couple in providing support and guidance during the planning stages of the wedding ceremony and through the final vows of the wedding ceremony itself. Esequiel "Zeke" Rivera and Associates (Independent Contractor) agrees to perform the ceremony in a respectful and professional manner in accordance with the ceremony planned by the Couple. Esequiel "Zeke" Rivera and Associates (Independent Contractor) will dress appropriately for the wedding and arrive early on the day of the ceremony. In the unlikely event that Esequiel "Zeke" Rivera and Associates (Independent Contractor) are unable to perform the ceremony for unforeseen circumstances (ie. death, accident, injury, etc.), In case of death, accident or injury, Esequiel "Zeke" Rivera and/or Associates (Independent Contractor) will do his/her best to find a replacement. Your Wedding Officiant (Independent Contractor) agrees to sign the wedding license after the ceremony and will return it back to the Hall of Records within 10 working days after the wedding.
DEFAULT: The occurrence of any of the following shall constitute a material default under this contract:
The failure to make a required payment when due.
The failure to make available or deliver the Services in the time and manner provided for in this Contract.
REMEDIES: in addition to any and all other rights a party may have available according to law, if a party defaults by failing to substantially perform any provision, term or condition of this Contract (including without limitation the failure to make a monetary payment when due), the other party may terminate the Contract by providing written notice to the defaulting party. This notice shall describe with sufficient detail the nature of the default. The party receiving such notice shall have 20 working days from the effective date of such notice to cure the default(s). Unless waived in writing by a party providing notice, the failure to cure the defaults within such time period shall result in the automatic termination of this Contract.
ENTIRE AGREEMENT: This Contract contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Contract. This Contract supersedes any prior written or oral agreements between the parties.
SEVERABILITY: If any provision of this Contract will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Contract is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so limited.
AMENDMENT: This Contract may be modified or amended in writing by mutual agreement between the parties, if the writing is signed by the party obligated under the amendment.
GOVERNING LAW: This Contract shall be construed in accordance with the laws of the State of California.
NOTICE: Any notice or communication required or permitted under this Contract shall be sufficiently given if delivered in person or by certified mail, return receipt requested, to the address set forth in the opening paragraph or to such other address as one party may have furnished to the other in writing.
WAIVER OF CONTRACTUAL RIGHT: The failure of either party to enforce any provision of this Contract shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Contract.
ATTORNEY'S FEES TO PREVAILING PARTY: In any action arising hereunder or any separate action pertaining to the validity of this Agreement, the prevailing party shall be awarded reasonable attorney's fees and costs, both in the trial court and on appeal.
CONSTRUCTION AND INTERPRETATION: The rule requiring construction or interpretation against the drafter is waived. The document shall be deemed as if it were drafted by both parties in a mutual effort.
IN WITNESS WHEREOF, the parties hereto agree to the terms and conditions as described above and have caused this contract to be signed on the dates indicated below. This contract, once signed, is considered by all parties within to be legal and binding in accordance with the conditions set forth herein, and shall abide by the agreed upon terms. The parties agree that the specifics of the agreed ceremony shall be considered a part of this contract after signing.

NO REFUNDS FOR NOTARY SERVICES RENDERED AND COMPLETED WITHIN A TIMELY MANNER AND OR FOR ANY DEPOSITS PAID TO HOLD A DATE AND FOR TIME FOR ALL PROFESSIONAL SERVICES PROVIDED IN GOOD FAITH.
