  • We have 2 ways of starting this process. Pay a fully refundable $295.00 fee for being connected to all our systems for 30 days to trial and view. This includes completing our application process (no obligation) and providing the required information to meet our lawfully required evaluation of your fitness to be a franchisee as well the required access to the franchise documents required by the Franchising Code of Conduct. A brochure with information and references is also provided.

    If you proceed the $295 is deducted from your purchase price. It is all tax deductible by the way. If you choose not to proceed you may request in writing for the $295 to be refunded.

    The second alternative is to pay no access fee at this stage and simply completing our application process (no obligation) and providing the required information to meet our lawfully required evaluation of your fitness to be a franchisee applicant. The brochure with information and references is also provided.

  • NOW THIS DEED WITNESSES:

     

    In consideration of the entities described in Schedule 4 (“The Entity”) agreeing to supply the recipients identified in Schedule 2 (“Recipient”) with the proprietary information and documentation described in Schedule 1 (“the Information”) for the purpose authorized in Schedule 2 (“the Purpose”), the Recipient acknowledges and agrees that they will:

    1.     Keep the Information secure and confidential.

    2.     Return the Information to The Entity on demand.

    3.     Not use the information for any purpose other than the Purpose without the prior written consent of The Entity.

    4.     Obtain from their employees, agents or successors in title a written undertaking in favour of the Entity to maintain the confidentiality of the Information, following 7 days written notice from the Entity to do so.

    5.     Neither divulge nor permit their employees, agents or successors in title to divulge the Information to any third party without The Entity’s prior written consent, other than to a subsidiary or related company to whom such disclosure is necessary for the Purpose.

    6.     Not make disclosure to a subsidiary or related company pursuant to paragraph 5 without first obtaining a written confidentiality undertaking from it in favour of The Entity.

    7.     Not make or allow their employees or agents to make any copy of the Information without the prior written consent of The Entity.

    8.     Recognize that The Entity’s Trademarks and Logos are the property of The Entity.

    9.     Not use the words described in Schedule 5 (“The Words”) in any way including in any name, trade mark, logo or in a business name wheresoever registered or in a company name wheresoever incorporated without the prior written consent of The Entity.

    10.  If using The Words with consent, they will immediately cease using The Words if the Recipient subsequently decides not to enter an Agreement with the Entity.

    11.  Recognize the copyright in the information.

    12.  Not to challenge The Entity’s rights to the Information or to the copyright subsisting therein. 

    13.  Indemnify The Entity against all costs and liabilities arising in connection with a breach of these obligations.

  • SCHEDULE 1

    The Information
  • All information concerning any of the Franchise Business and Services Systems known as the systems (“The Franchise System”)(as also described in Schedule 6 below) which information shall include but not be limited to intellectual property, software management systems, reports and associated support procedures, trade methods and concepts, stationery, marketing material, operations, manuals, procedures and policy, training manuals and all formulae, processes and products used in the Franchise business, correspondence, client database, directory and related information, information concerning the ownership financial structure and position of The Entities and/or its servants or agents and/or its brokers or licensees.

  • The Information is to be used solely for the purpose of discussions and negotiations to enable applicants to decide whether to enter into a franchise, agency, joint venture, partnership, employment, contracting, hire or license agreement with The Entity or any of their related bodies, servants or agents.

  • Agreement and Electronic Communication Consent

  • The Jtax Group markets:

    as agent for J Tax Training Trust (“Supplier”) (abn 32 170 616 446) career path training, assessment and mentoring to seek to meet career enhancing licensing for professional body membership and licensing qualification requirements, including but not limited to BAS, Tax, Financial Planning, Finance Broking, Real Property Management & Sales and Accounting Practice Operations (“Services”).
    as agent for J Tax Marketing Trust (“Supplier”) (abn 50 614 402 891) the right to client work or the purchase of clients or marketing assistance to obtain clients;
    in its own right and as duly appointed Regional Franchisors [“RFSOR”] J Tax franchises and associated livery, materials, supplies and ongoing generic franchise-specific education and counselling, subject to applicants first meeting minimum education, qualifications, experience and achieving successful assessment.
    The person(s) named in Schedule 3 above (“Applicant”) specifically acknowledges that it wishes to commence a bookkeeping or accounting or similar service business (“Business”) providing the Services in its own right and wishes to enquire and or apply for career path training, assessment and mentoring to meet licensing and professional body requirements to enable them to conduct such a Business and provide such Services lawfully. The Applicant may also wish to purchase a J Tax franchise, but is not obligated to do so.

    This Agreement and Electronic Communication Consent ("Consent") applies to this Agreement and other communications we may provide you including amendments, in electronic form.

    By agreeing to electronic delivery, the person(s) or entity/ies wishing to enquire, apply for or the making of any purchase from Jtax Group is giving its informed consent to electronic delivery of all communications and agreeing to its terms and conditions. The terms and conditions in this Consent endure between JTAX GROUP and the Applicant for successful and unsuccessful applications or agreements and applications or agreements discontinued for any reason whatsoever.

    The words "we," "us," and "our" refer to the entity or entities with which you have your Supply or Franchise Application and/or its Suppliers, and the words "you" and "your" and “I” mean you, the individual(s) or entity Applicant identified on the Supply or Franchise Application(s). As used in this Consent, "Application" means the Application(s) you have with us now or in the future, or any further agreements or amendments resulting from the Application(s) during the course of the relationship between Jtax Group, its RFSOR(s) and its Supplier(s) and the Applicant, which relationship is for the purpose of assisting you in commencing or running your Business or obtaining training assessment or mentoring as a prerequisite to commencing your Business at your request.

    The JTAX GROUP wishes to be environmentally responsible to the extent possible by having a paperless documentation program.

    You consent to JTAX GROUP communicating electronically with you about your Supply or Franchise Application and any subsequent Agreement(s) with us. You nominate and authorise JTAX GROUP or the RFSOR(s) or Supplier(s) to act on instructions it(they) has(have) received electronically. This Consent and authority will apply to all communications permitted to take place electronically by law (including any applicable Industry Code or Code of Conduct or its amendment(s)). "Communication" means any agreements or amendments thereto, account invoices, deposits, pricing, disclosures, notices, manuals, procedures and policies and all other information related to JTAX GROUP products, services or supplier or other accounts, including but not limited to information that we are required by law to provide to you in writing.

    Scope of Communications to Be Provided in Electronic Form

    You agree that we may provide you with Communications in electronic format, and that we may discontinue sending paper Communications to you, unless and until you withdraw your consent as described below. Your consent to receive electronic communications and transactions includes, but is not limited to:

    All legal and regulatory disclosures and communications associated with your Supply or Franchise Application being applied for. Examples of other products are Applicant specified training, entity structure setup, other setup and equipment requested in preparation for the commencement of the Applicant’s Business. Examples of other Business commencement services are Applicant specified marketing, web-site, Business operations and procedures, which may not be included in a subsequent purchase (if accepted) of a franchise.
    Notices or disclosures about a change in the terms of your Supply or Franchise Application or associated payment terms and responses to complaints and formal Notices of Dispute set out in any applicable Code of Conduct or Code of Ethics set out in applicable law or promulgated by recognised professional bodies.
    Privacy policies and notices.
    Method of Providing Communications to You in Electronic Form

    We will rely on this consent to communicate with you by:

    (a) electronic mail (“e-mail") to the e-mail address and fax address that you have notified to us requiring you to download a PDF file containing the Communication;

    (b) making a notice available for you to access on our intra-net (Google Drive or similar) or other electronic storage maintained by the JTAX GROUP, RFSOR(s) or Supplier(s);

    (c) any other method of electronic communication; and/or

    (d) ordinary mail to the address on our records; and/or

    (e) facsimile (“fax”) to the address on our records. 

    For example, we might send an email to your email address each month to tell you that your statement of your account can be viewed.

    Communications in Paper Form No Longer Required

    By giving this consent, we are no longer required to send you Disclosure, Agreements, Account information, notices or other documents identified in this Agreement in paper form for the Applicant now or in the future.

    How to Withdraw Consent

    You may withdraw your consent to receive Communications in electronic form by e-mailing us at info@jtax.com.au

    At our option, we may treat your provision of an invalid email address, or the subsequent malfunction of a previously valid email address, as a withdrawal of your consent to receive electronic Communications. We will not impose any fee to process the withdrawal of your consent to receive electronic Communications. Any withdrawal of your consent to receive electronic Communications will be effective only after we have a reasonable period of time to process your withdrawal.

    If you decide to return to paper notices and other documents, you are asking to receive those documents on paper, delivered by post to your nominated street address.

    How to Update Your Records

    It is your responsibility to provide us with true, accurate and complete e-mail address, contact, and other information related to this Consent:

    You must ensure that:

    (a) you check your email regularly for notices and other communication from us;

    (b) your email address remains current (or otherwise notified to us); and

    (c) emails from us to your email address are not blocked.

    We rely on you to keep your nominated e-mail or physical (street) address details up-to-date and to notify us when they change.

    Hardware and Software Requirements

    To access, view, retrieve, print and save a copy of the documents that we make available to you in electronic form, you must have the following hardware and software:

    An e-mail account with an Internet service provider and e-mail software in order to receive electronic communications from us;

    An up-to-date internet browser. Ask us for our current list of browsers that meet our intra-net or other site security requirements;
    Local, electronic storage capacity to retain our Communications and/or a printer to print them;
    A valid e-mail account with and address no longer than 30 characters and software to access it;
    An up-to-date device or devices (e.g., computer, smartphone, tablet, etc.) suitable for connecting to the Internet;
    Software that enables you to view files in the Portable Document Format ("PDF").
    Communications in Writing

    All Communications in either electronic or paper format from us to you will be considered "in writing". You should print or download for your records a copy of this Consent and any other Communication that is important to you.

    Laws

    You acknowledge and agree that your consent to electronic communications is being provided in connection with a transaction affecting our commerce that is or may be subject to the Electronic Transactions Act (Victoria) 2000, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

    Termination/Changes

    We reserve the right, in our sole discretion, to discontinue the provision of your electronic communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.

    Acceptance and Consent

    By consenting to this Agreement, you agree to the following statements:

    I have read, understand and agree to be bound by the terms and conditions described above and consent to receive electronic documents according to the process described above.

    I understand and agree that:

    (i) certain documents will continue to be delivered to me via mail that are not included in the JJTAX GROUP paperless program and that in the future some or all of these documents may be made available for me to view online in accordance with this Agreement;

    (ii) my consent to view documents electronically does not automatically expire and is not limited as to duration;

    (iii) the entity or entities with which I have my Supply and or Franchise Application(s) and/or their agents may revoke my participation in the JTAX GROUP paperless program at any time at their discretion;

    (iv) neither entity or entities with which I have my Supply and or Franchise Application(s) nor their agents will be liable for any loss, liability, cost, expense, or claim for acting upon this authorization or arising from my use of the product or services provided pursuant to this Consent; and

    (v) inserts that may be provided along with my account statements contain important information or disclosures concerning my business and I agree to review such inserts in a timely manner.

  • By signing this Consent, the First Person Applicant accepts the terms of the Confidentiality Agreement and consents to the use of electronic communication as per the email address and/or fax number provided above as a method of communication with JTAX GROUP for and on behalf of all Applicants (if applicable).
