TERMS AND CONDITIONS OF BUSINESS
FOR THE SUBSEQUENT ENGAGEMENT OF A CONTRACTOR/TEMPORARY
1 PARTIES
These Terms and Conditions are between MinStaff Survey Pty Ltd and the Client Employer and specify the terms upon which we will provide services to you until new Terms and Conditions are notified to you in writing.
2 ACCEPTANCE OF TERMS OF BUSINESS
The issuing of a contract or Purchase Order to MinStaff Survey to undertake work and provide survey personnel to the Client will be taken as the Client’s acceptance of these Terms of Business.
No variation can be made to these Terms of Business without the written agreement of both MinStaff survey and the client.
3 EMPLOYMENT OF MINSTAFF SURVEY PERSONNEL
Should the Client directly employ an individual who has been introduced to the Client by MinStaff Survey, either a potential surveyor or who has been provided to the Client by MinStaff Survey as a surveyor to undertake survey works, the Client agrees to pay MinStaff Survey a Placement Fee.
The Placement Fee will apply in circumstances where the surveyor is either engaged directly by the Client or the Client refers the surveyor to another division of the Client’s business or to a related or associated company or to another employer and that other division, related or associated company or other employer engages the surveyor.
The Placement Fee shall only apply where the Client engages the surveyor or refers the surveyor within 6 months of MinStaff Survey’s work with the Client being completed.
4 PLACEMENT FEE
The Placement fee will be payable to MinStaff survey by the date the surveyor commences employment with the Client and shall be calculated as 10% of the surveyor’s Total fixed Remuneration plus GST.
“Total Fixed Remuneration” shall be all payments paid to the surveyor including base salary, any allowances and superannuation calculated for a 12 month period.
5 SUITABILITY OF CANDIDATES
Whilst we will make every reasonable effort to ensure the suitability of candidates, we do not accept liability for any loss, expense, damage or delay arising in connection with a candidate irrespective of how they are caused. You will need to satisfy yourself as to their integrity, qualifications, suitability and where relevant medical condition for the position concerned has been met by the candidate. The final recruitment decision rests with you.
