The terms “us” or “we” or “our” herein refers to ‘Zenko Yoga’. By signing and submitting the application for the yoga teacher training applicants acknowledge and agree to abide by the terms and conditions below and all Zenko Yoga policies.
These Teacher Training Course General Terms and Conditions ("Terms") are a legally binding document that apply to enrolment in any courses promoted or hosted by Zenko Yoga (“Agent”) and delivered by the Teachers (“Principles”).
"Customer" means the authorized purchasing individual or entity.
PLEASE READ THESE TERMS CAREFULLY. ANY ORDER FOR TEACHER TRAINING COURSES OR ANY ACT BY CUSTOMER ACCEPTING THE BENEFITS OF THE TEACHER TRAINING COURSES SHALL BE CONCLUSIVE EVIDENCE OF CUSTOMER'S ACCEPTANCE OF THESE TERMS.
To be accepted in any teacher training courses offered by Zenko Yoga, we must ensure that Applicants have fully read and understood these Training Course General Terms and Conditions. For the avoidance of doubt, prior to submitting your course deposit, applicants are required to read and agree to this document.
All registration orders are subject to acceptance by the Agent. The Agent will not be bound by any terms or conditions of Customer's registration order that are inconsistent.
Fees for courses shall be in accordance with the prices listed on the Website and in effect on the date of registration of the course. The Agent reserves the right to adjust such fees at any time without notice. Customer shall pay the Agent for training courses according to the Training Course Terms and Conditions.
Once the Customer has secured their place on the training with a deposit, within 28 days they must arrange with the Agent their preferred payment option for the balance of course fees.
50% of the total course fee must be paid prior to commencement of the course.
For the 6 Month Training, course fees are to be fully paid 3 months prior to the scheduled end date of the training.
For the 12 Month Training, course fees are to be fully paid 6 months prior to the scheduled end date of the training.
The minimum amount for any payment plan transaction is $400.
Please be absolutely sure that you can make the training dates and wish to do the full course before confirming your booking. Customer may cancel course registration by notifying the Agent in writing by email. Any refund will be based on the date the written cancellation request is received by the Agent.
All deposits are Non Refundable under any circumstances.
The cancellation policy is as follows:
No fee for cancellations made more than 75 days prior to the start of the training
$500 fee for cancellations made 45-75 days before the start of the training
$1500 fee for cancellations made within 45 days prior to the start of the training
Full course fee forfeited for cancellations made within 30 days
On the rare occasion that the Zenko Yoga training is cancelled, the Agent will refund the Customer entirely.
The Agent is not responsible for any travel costs that you incur to participate in the training.
Once the program begins, tuition is non-refundable and non-transferable.
Work Product - Copyright and Trademark(s)
In connection with the performance of a training course, the Agent and the Principle(s) may deliver to Customer work product, defined as works of authorship, training manuals, documentation, reports, drawings and similar works ("Work Product"). Customer acknowledges and agrees that the Agent, the Principle(s), its licensors, or its contractors own all Work Product.
All Work Product delivered to Customer pursuant to these Terms shall be and remain the property of the Principle(s) and Agent. The Agent and the Principle(s) grants to Customer a limited, non-exclusive, non-transferable license to use the Work Product for Customer's use during the training course.
Customer shall not reproduce, copy, display, distribute, modify or prepare derivative works of the Work Product. Any advertised course content is correct at the time of print; however the Agent and the Principle(s) reserve the right to amend the content schedule without prior notice to suit the level of attendees on the course.
Advertised course content should be taken as a general guideline only.
Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, AGENT AND PRINCIPLE(S) AGGREGATE LIABILITY TO CUSTOMER OR TO ANY THIRD PARTY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR A COURSE PROVIDED BY THE AGENTS AND/OR PRINCIPLE(S) HEREUNDER, WHETHER FOR BREACH OF CONTRACT OR IN TORT, WILL BE LIMITED TO THE FEES PAID BY CUSTOMER FOR THE COURSE WHICH IS THE SUBJECT MATTER OF THE CLAIMS. IN NO EVENT WILL AGENT AND PRINCIPLE(S) BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE IN CONNECTION WITH OR ARISING OUT OF THESE TERMS OR A COURSE PROVIDED BY AGENT, PRINCIPLE(S) HEREUNDER (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES WHETHER FOR BREACH OF CONTRACT OR IN TORT, EVEN IF AGENT, PRINCIPLE(S) AS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE.
If any provision of these Terms is held to be unenforceable, these Terms will remain in full force and effect with the provision omitted. No delay or omission to exercise any right or remedy accruing to the Agent upon any breach or default of Customer shall impair that right or remedy, or be construed to be a waiver of any breach or default. A waiver by the Agent of any breach or default under these Terms must be in writing and executed by an authorized officer of the Agent.
It is the responsibility of the customer to inform the Agent of any change of address, contact phone number or email address, both before and after receipt of the goods (i.e. course correspondence components) please note that our preferred method of contact for customers is by email, so care should be taken to provide a current, valid email address.
Although great care is taken, the customer is entirely and solely responsible for their own safety, health and general well-being. Please advise the Agent and Principle(s) at the time of enrolment and acceptance in to the course of any known injuries, ailments, disabilities, medication you are taking or anything else that may affect your ability to fully participate in the course (this is covered by your completion of the Application Form on the Zenko Yoga Website).
You are responsible for taking preventative measures/action throughout the course to protect yourself from injury (i.e. be sensible – if it hurts, causes any pain or strain – do not do it).
The customer is entirely and solely responsible for their own belongings/ valuables.
A party is not liable under these Terms for non-performance caused by events or conditions beyond that party's control. This provision does not relieve Customer of its obligation to fulfil payment obligations.
Neither party shall assign or otherwise transfer any of its rights or obligations under these Terms, except that the Agent may assign its right to payment to an affiliated company. The Agent may subcontract its obligations under these Terms.
These Terms constitute the parties' entire agreement relating to the subject matter. It supersedes all prior communications between the parties. No modification to these Terms will be binding, unless in writing and signed by an authorized representative of each party.
Any dispute related to these Terms will be governed by Australian Law in the respective State or Commonwealth jurisdictions. I have read the above terms and conditions and agree to be fully bound by them. Entry to the event will not be permitted without these terms being signed and returned to the Agent prior to the event.
