  • St. Croix Waiver

  • 1. A minimum crew of 4 is required. The resume of a second qualified skipper must be submitted in advance and approved in advance. The purpose of the 2nd skipper is to provide a safety cushion for the remaining crew and vessel if the 1st skipper were to become incapacitated and have to leave the charter party.

    2. Vessels are required to arrive at a designated safe harbor in sufficient time to be at anchor one hour prior to sunset. Vessels are restricted to the ports of Christiansted, Frederiksted, Buck Island, and Green Cay Marina.

    3. CYOA does not provide any charts of the area. You will be required to provide these charts and to show them to your checkout captain prior to the issuance of this approval.

    4. If the chartered yacht does NOT have davits for hoisting the tender the tender bowline must be extended with a long line (use one or more dock lines) to increase the tow line length, reduce loading on the towing connection and keep the tender from running down the main vessel. DO NOT FORGET THIS EXTENSION, OR RUN IT OVER, AS IT IS NOT POLYPROPOLENE AND DOES NOT FLOAT. DAMAGE OR LOSS OF THE ENGINE OR DINGHY OR DAMAGE TO THE YACHT CAUSED BY RUNNING OVER THE DINGHY OR THE TOW LINE IS NOT COVERED BY THE PURCHASED INSURANCE.

     5. CYOA does not have a chase call network or any other commercial arrangements in St. Croix. Incidental repairs to the yacht must be arranged by and on behalf of the charter party. Keep receipts for reimbursement by CYOA. Any expenditure, in excess of $50, must be approved in advance by the CYOA office.

    6. THERE WILL BE NO ADJUSTMENTS MADE FOR LOST TIME DUE TO MECHANICAL PROBLEMS OR WEATHER DELAY.

    7. This approval is contingent. You will be required to orally explain your navigation plan for this leg of your trip during your charter checkout. Only then, after he is satisfied, will the dock manager issue the final OK for your trip to St Croix.

    8. You are reminded that under the terms of the demise contract you are solely responsible for the yacht and its condition. If, in your opinion, there is even the slightest question as to the suitability of the yacht for the intended use, or the suitability of the weather, it is incumbent you exercise good judgment and prudent seamanship and remain in the coastal waters of the US and British Virgin Islands

    9. The minimum charge for returning a vessel to CYOA that is left in St. Croix is $1,000. Charges will be based upon out of pocket expenses for time and material plus loss of charter revenue, if any.

  • CYOA Provided Sailing Guide Agreement

  • CYOA provides experienced mature Sailing Guides at your request, or if we have deemed it necessary. All CYOA Sailing Guides are carefully screened.

A Sailing Guide will make your charter more relaxing and more interesting for inexperienced as well as experienced crews. The Sailing Guide is paid to familiarize you with your chartered boat and determine that you are capable of proceeding without them or, if engaged for a longer time period, to sail the
boat for you or assist you with the sailing chores. The Sailing Guide is not a cook, maid or babysitter, but, you can expect our guides to pitch in as a member of the crew.

    A few guidelines:
 The guide must have their own private sleeping cabin.
 The guide must be provided with provisions while on board. If you choose to go ashore for a meal you are not expected to take the guide (although most do so) but a meal must be provided for.
 Return the guide to the original departure point if he is not onboard for the entire charter. This means taxi and/or ferry fare.
 Guides rely on gratuities for a substantial portion of their earnings. It is customary and appreciated to receive a gratuity of $50 to $100 per day depending on the size of the vessel, number of persons on board and the level of service provided.
 The security deposit you paid upon boarding lowers your exposure for the uninsured portion of the vessel and inventory. Even though a Sailing Guide is aboard the general condition of the vessel and any inventory losses are your responsibility. You are not responsible if the guide directly causes loss or damage. You are responsible if you fail to heed his advice, suggestions or specific instructions and loss or damage occurs.
 The guide is not permitted to allow the tender to be operated by minor children or adults that have not been successfully checked out on the safe and sensible use of the tender and outboard engine. At no time are minor children allowed to operate the tender at speed (on a plane) unless accompanied by their parent or guardian.

Please indicate that you have read this sheet and that you accept these guidelines by completing the spaces below.

  • CYOA Application to Charter

  • CYOA reserves the right to restrict yacht usage to those deemed competent. If there is reasonable doubt about the Captain's competence a Sailing Guide may be placed aboard at the Charterer’s expense for one or more days. The decision of the Fleet Manager will be final.

I certify that the statements herein are true and accurate and I understand that this application will be annexed to the Charter Contract by reference. I further certify that I am experienced, competent and capable of assuming the responsibilities of a skipper on the yacht chartered, in the areas of piloting, seamanship, practical knowledge, crew management and the Rules of the Road.
