    • The Problem You Have 
    • Payment for Repairs: I have read and understood the Motor Vehicle Insurance and Repair Industry Code of Conduct commencing 1 May 2017, and note my obligations and those of insurers detailed under the Code.

      First and foremost I say the insurer has breached the Code at Clause 1 - Standards of fair-trading, process and transparency in the relationship between Insurers and Repairers because they failed to be open (transparent) in their dealing with me because they have not satisfactorily explained why they refusing to pay me for legitimate repair work as defined by the Code at the pre-commencement stage (i.e. prior t a 'repair Authority'being issued by the insurer.  

      I also say specifically that the insurer has breached its obligations under Clauses 8.1 and/or 8.2 and/or 8.3 of the code.  The insurer is required under Clause 10 and sub-Clause 10.3 (a) to make their determination within 2 business days after reciveing this IDR.

    • I therefore say that the insurer has breached both the letter and spirit of the Code, and I request that this matter be reviewed in a timely fashion and within the Guidelines stipulated within the Code.

    • I have provided all relevant invoices and documentation to the insurer under 9.4 of the code i.e. "Repairers will provide sufficient evidence to an Insurer to substantiate their claims for costs in relation to parts and work undertaken in a repair for that Insuer". I seek that the Insurer makes full payment to me.
