A binding financial agreement creates certainty and security as to your financial relationship. You may make a BFA before or during a relationship or after separation. Each party to a BFA must obtain legal advice. We can prepare and advise you on your BFA.
We will arrange for the preparation of a divorce application, arrange for you (and your spouse if applicable) to sign it, file it with the Family Court and send you a copy of the degree absolute of divorce.
Family Court consent orders are a means of formalising an agreement relating to property and/or parenting following separation. You will have to satisfy the Court that your agreement is fair and reasonable. We will prepare and lodge your application at the Court without either party needing to appear in Court. Consent orders are legally binding and facilitate property transfers with nominal ($20) transfer duty.
You need advice and information to make the right decisions. If you're not sure where you stand or what course of action is best, talk to our family law team.
Mediation is a method of dispute resolution which brings the parties together for discussion and resolution or disputes. Mediation works best if both parties have obtained advice about their entitlements. For many people mediation is an attractive alternative to contested proceedings in the Family Court.
Book an appointment to discuss your requirements prior to mediation. We will give you a fixed price quote for further representation after the meeting with you.
It's common for consent orders or binding financial agreements to include a transfer of real estate, often in exchange for a cash payment. It makes sense to sign the transfer papers at the same time as signing the application for consent orders or binding agreements.
