  • I/We sign this application with the understanding that I/we agree to pay our invoices according to your terms of net 10th prox, and with the understanding that a 1.5% monthly service charge will be applied to all past due balances. I/We understand that Little Hardware Company, Inc. has a minimum charge of $3.00 per invoice and that I/we agree to these conditions. It is also understood that the information furnished by this application is intended for use in extension of commercial or business credit only. I/We agree to immediately notify Little Hardware Company, Inc. of any change of ownership or form of said business. I/We furthermore understand that upon any change in name or ownership, Little Hardware Company, Inc. reserves the right to suspend extension of credit until an updated credit application is submitted and processed. LIABILITY. Little Hardware Company, Inc. shall not be liable for any delays or for any failure to supply or deliver goods resulting from carriers’ or manufacturers’ delays or regulations of any government authority.I/We, the undersigned, notwithstanding any corporate title which may be indicated, do hereby agree to be individually, jointly and severally responsible for the obligations to your company or companies extended as a direct or indirect result of this application for credit. It is hereby specifically agreed that if it becomes necessary to place this account with an agency and/or attorney for collection, I/we agree to pay all costs involved including agency fees, attorney fees, court costs and interest. I/We also hereby waive the privilege of having venue changed to the county of our residence, and that it shall remain in the county where the goods are sold.With respect to materials and/or supplies not manufactured by Little Hardware Company, Inc., hereinafter referred to as Vendor, the warranty obligations of Vendor shall in all respects conform and be limited to the warranty, if any, actually extended to Vendor by its supplier. The foregoing warranties are exclusive and in lieu of all other express and implied warranties of merchantability and fitness for a particular purpose (except warranties of title), which are expressly disclaimed except as set forth herein. Vendor shall not be subject to any other obligations or liabilities whatsoever with respect to equipment manufactured by its suppliers or services rendered by Vendor.
