hereinafter called Licensee.
PARKING SPACE. Subject to the terms and conditions of this Agreement, Licensor grants Licensee a license to parking in the Leland FPG, located at 1919 Smith Street, Houston, Texas. Parking space assignment will be given at application completion and receipt of payment. The parking space assignment may be subject to change to accommodate hybrid parking or garage renovations.
USE. Licensee shall use the Parking Space for parking purposes only. Licensee shall not use the Parking Space for any recreational or other oversized vehicle, unless otherwise agreed to in writing by GSA. The following requirements apply to all who park in the Leland FPG:
· You must appropriately display the issued parking permit in your vehicle at all times in the garage to avoid receiving a ticket and/or the possible towing of your vehicle (at your expense).
· You must possess liability insurance (as required by Texas State Law).
· You must park ONLY in your assigned parking space, to avoid ticketing and/or the possible towing of your vehicle.
SECURITY DEPOSIT. At the time of the signing of this agreement, a security deposit of $125.00 is required. This will be applied to the last month’s rent upon written notification of terminating this agreement (or applied to cover unpaid parking privileges for those who have had privileges terminated). As the monthly rate changes, the deposit total should reflect the change in monthly fees. You will be covered by this agreement until your return the parking hang tag (or permit) to Park Select. This agreement is considered to be in affect and parking charges in force until the hangtag (or permit) is received.
GUARANTEE DEPOSIT. Any deposit which may be required to guarantee compliance with the terms and conditions of this license shall be in the amount designated above, and shall be submitted in any form accepted by GSA’s Authorized Representative, Park Select, including a certified check, cashier's check, postal money order or electronic payment posted at www.ParkSelectGov.com
LATE CHARGES AND FEES. If, Licensee fails to pay the rent in full on or before the fifth (5th) day of the month, Licensee shall pay Licensor a late charge of $20.00 applicable on the sixth (6th) day of the month. Licensor does not waive the right to insist on payment of the rent in full on the date it is due.
AVAILABILITY. Licensee shall have access and use of the Parking Space as follows: 24/7, 365 days per year. Notwithstanding the foregoing, GSA reserves the right to close the Licensed Premises, or any part thereof, for regular or emergency maintenance or if, in its sole discretion, the Licensed Premises is deemed unsafe for use. In such event, Licensor shall make best efforts to notify Licensee of such closure at least forty-eight (48) hours in advance.
TERMINATION. Either Licensor or Licensee may terminate this Agreement by giving the other party at least 30 day’s written notice, with such termination to be effective as of the last day of any given month. Licensor shall NOT prorate the last month’s rent if Licensee stops using the Parking Space prior to the end of the month.
RENEWAL TERMS. This agreement shall automatically renew for an additional month unless 30 day’s advance written notice of termination provided. Agreement terms for month-to-month renewal shall be the same as those contained in this agreement.
ACCESS KEYCARD AND HANG TAG. Licensor will provide Licensee with one security access keycard and one hang tag. Replacement cards and hang tags must be obtained through the Licensor at which time an additional fee maybe incurred. If Licensee fails to return the security access keycard and hang tag to the Licensor at the termination of this Agreement, then the Licensee may be subject to a replacement fee of $10.00 for each replaced item.
SUBLICENSE AND ASSIGNMENT. Licensee shall not sublicense or assign the Agreement without the prior written consent of GSA.
LIABILITY. Licensor or GSA is not responsible and assumes no liability for any items left in any vehicle parked in the Parking Space. Licensee should remove all valuables from the vehicle, and should lock the vehicle. Licensor or GSA is not liable to Licensee for any theft or damage to the Licensee’s vehicle. If Licensee wishes to insure his or her vehicle and/or personal possessions against damage or loss, then Licensee should obtain his or her own insurance. Licensee shall be liable for any damage to the Parking Space or surrounding property caused by negligent, intentional or willful acts of the Licensee.
GROUNDS FOR TERMINATION. Licensee’s failure to comply with any terms of this Agreement shall be grounds for termination of the Agreement, with appropriate notice to the Licensee and procedures as required by law. Licensee shall remove the vehicle immediately from the Parking Space upon receipt of the Licensor’s notice of termination of the Agreement.
Licensee’s failure to pay rent by the 10th of the month automatically forfeits future month’s privileges, thus terminating their agreement. Therefore, Lecensee will relinquish parking privileges (and parking permit) on the last day of that month.
VIOLATIONS OF PARKING REQUIREMENTS.
· Anyone parking in a space other than the assigned location is subject to ticketing and/or towing at their expense.
· If you gain access by an electronic identification badge and the parking permit is not displayed appropriately, you will be subject to ticketing and/or towing at your expense.
Repeated violations and/or disregard for the safety of others in the parking lot can result in the revocation of parking privileges and nullifies this agreement.
GARAGE RULES AND REGULATIONS. All persons with garage access must abide by the Rules and Regulations Governing Conduct on Federal Property in the Federal Management Regulation Title 41, Code of Federal Regulations, Part 102-74, Subpart C.
RESTRICTIONS APPLYING TO FEDERAL PARKING FACILITIES:
As stated in 41 CFR, Chapter 101.20.104-2, “Parking spaces not required for official needs may be used for employee parking.” General Services Administration will give parking priority to federal agencies that contract for office space through GSA. Parking spaces will be made accessible to individual employees through Park Select as space is determined to be available by GSA. Nothing in this agreement stipulates or infers “permanent parking privileges.”
