Applies to weddings booked after January 1, 2017 unless otherwise stated in the Custom Package section.

Exclusive Photographer

EdVaflor Photography will be the sole Professional Photographer at the Event (excludes photobooths).

Booking Fee/Deposit

The deposit listed for the chosen package below is required when the client agrees to the terms and conditions of this Contract. Dates are reserved when the Booking fee is paid. The Booking Fee will be subtracted from the total cost of the Package.

Payment & Prices

All package costs are stated at the time of booking and will remain once booking is confirmed. No images will be given to the client until full payment has been paid to EdVaflor Photography. Full payment is due the day of the event. The following package prices are good until December 31, 2022.

Cancellation

If the Client cancels this Agreement ninety (90) or more calendar days before the event date, any deposit paid to the Photographer will be refunded in full. If the client cancels between ninety (90) and thirty (30) days of the event date and if the Photographer does not obtain another assignment for that date, half of the deposit will be refunded. The deposit is non-refundable if the Client cancels within thirty (30) days of the event date.

Copyright & Reproductions

The Photographer will own the copyright in all images created and will have the exclusive right to make reproductions. The Photographer will only make reproductions for the Client or for the Photographer's portfolio, samples, self-promotion, entry in photographic contests or art exhibitions, editorial use, internet, or for display within or on the outside of the Photographer's studio. All packages include a DVD and a copyright release letter allowing the client to make unlimited printed photographs for their personal use of their engagement and/or wedding images on the DVD.

Failure to Perform/Acts of God

The Photographer takes every care to performance of this Contract. But Contract is subject to Acts of God beyond our control (i.e. Fire or Police action). Limitation of Liability in the unlikely event that all or some of the photographs fail to materialize or there is a total photographic failure due to reasons beyond the Photographer's control, the liability of the Photographer will be limited to the refund of all money paid. Neither party will be liable for indirect or consequential losses. In any event, the limit of the Photographer's liability will not exceed the package price.

Miscellany

This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the State of Ohio.
