Community Provider Terms and Conditions
Scholars, Parents, Guardians, and Household Members:
1. Understand that Educational Support Resources are public school funds and that any attempt to use those funds for personal gain is a violation of the law.
2. All materials purchased with Educational Support Resources are the property of Compass Charter Schools (CCS). When a scholar is no longer enrolled in CCS all materials must be returned to the main office within 5 days of the exit date. If items are lost or damaged, the LC will receive an invoice from the school for the original cost of the item(s). Materials are not available for purchase from Compass Charter Schools.
3. Agree that Compass may deny or cancel any provider order, purchase order, or service agreement for any reason including because a scholar, parent, guardian, household member or close personal acquaintance is directly affiliated with the provider or is using said order for personal gain either directly or via quid pro quo.
4. Understand that Compass will interpret and enforce this Policy broadly so as to provide the greatest protection of public school funds.
5a. Scholars, parents, guardians, household members, and providers who know or have reason to know that any activity in which they are engaged may violate this Agreement are required to disclose such activities in writing in such a way as to fully inform the Superintendent & CEO, or their designee, of the activity and the reason why such activity may violate this policy.
5b. Parents and guardians who are found to have engaged in an activity in violation of this policy may lose the privilege of having their scholars participate in provider activities.
6. In rare circumstances, the Superintendent & CEO may grant an exception to this Policy after considering: the ability of the scholar to receive comparable materials or services from another provider, the total cost of the vendor agreement, the degree of relationship between the vendor and the scholar; and the nature of the materials and services including whether they are a piece of the core curriculum or are extracurricular in nature, and the degree to which the materials or services are aligned with the scholar’s educational goals. The Superintendent and CEO’s decision to grant an exception to this Policy is final.
Limitation of Liability for Ordered Supplies and Services
Compass Charter School funds the acquisition of Educational Support Resources (educational materials and supplies) as part of its Independent Study Program ("Program"). The Parent/Guardian or Learning Coach ("Parent") and Scholar acknowledge and agree to the following terms regarding the ordering, receipt, and use of such materials:
1. No Assumption of Liability: Compass assumes no liability for any supplies, materials, services or equipment ordered, purchased, or received through the Program. This includes, but is not limited to, books, curriculum materials, science kits, art supplies, technology, or any other educational items.
2. Use and Supervision: The Parent is solely responsible for ensuring that all materials and supplies are used safely, appropriately, and legally. The Parent agrees to supervise the Scholar's use of any such materials, particularly those that may pose safety risks, such as laboratory kits, tools, chemicals, or electronic devices. The Parent understands that Compass is not supervising students in activities provided by vendors pursuant to this program and that it is the Parent’s sole responsibility to do so. Parents should not leave students unsupervised with vendors hired to provide services through this process.
3. Indemnification: The Parent agrees to indemnify, defend, and hold harmless Compass, its officers, employees, agents, and affiliates from any and all claims, damages, injuries, liabilities, costs, or expenses (including attorney's fees) arising from the use or misuse of any materials or services obtained through the Program.
4. No Warranties: Compass makes no representations or warranties, express or implied, regarding the quality, safety, suitability, or effectiveness of any materials or services provided or approved for purchase through the Program. The Parent assumes all risks associated with the use of such materials and services.
5. Compliance with Laws and Policies: The Parent and Scholar agree to use all materials in compliance with applicable federal, state, and local laws, as well as Compass’s policies and procedures. Compass reserves the right to deny or revoke funding for materials deemed unsafe, inappropriate, or inconsistent with educational standards.
6. In consideration of Compass allowing my child to participate in services, I, on behalf of my myself, my child, our heirs and assignees, hereby release, covenant not to sue, discharge, and hold harmless Compass, and any board members, officers, officials, employees, volunteers, and/or representatives thereof (“Releasees”), of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence or other conduct of Compass, and any board members, officers, its officials, employees, volunteers, agents and/or representatives. I further agree that I shall indemnify and defend Compass and its board members, officers, officials, employees, volunteers, agents and/or representatives against any Claims.
7. By participating in the Options Program and receiving Educational Support Resources for materials and/or services, the Parent acknowledges and agrees to these terms and assumes full responsibility for the use of any materials or services ordered in light of the fact thar use of resources and services from this program is entirely optional and is not required to graduate from Compass.
