Borrowing agreement

To be completed by an employee of selectability's Bike Shed.

Terms and conditions

Please note insurance cover is your responsibility.

• I understand, have received a copy of the riding and safety rules and agree to abide by them.
• I acknowledge that by signing this application form, the selectability Bike Shed will not be held responsbilie in any way whatsoever, for any accident or injury I may sustain while riding.
• I accept full responsibility for all equipment borrowed by myself (or child if under the ages of 18 years), and agree to pay for any equipment damage incurred during my hire period and agree that I am responsible for any costs incurred to repair damage.
• I declare that all persons are able to, and capable of riding a bike of their own free will and ability.
• I will be mindful and apply commonsense to minimise and prevent any danger or risk occurring to myself (or child if under the age of 18 years), property and borrowed equipment.
• I will adhere to all local and government road safety rules, laws and guidelines whilst riding in both community and public areas.
• I agree to ensure that myself (or child if under the age of 18 years) will wear a helmet (legal requirement) at all times whilst riding a borrowed bike, and that equipment is used and applied in a safe manner.
• I take full responsibility for any and all equipment borrowed by myself, partner, third party (or child if under the age of 18 years), and apply suitable precautions against theft and/or damage by houseing or securing safely all borrowed equipment.
• I agree to be responsible for myself (or child if under the age of 18 years) and will be held responsible for all risk taken by myself (or child if under the age of 18 years) during activities.
• I agree NOT to lend or loan borrowed equipment to a third party during the borrowing period.
• I agree to return all borrowed equipment in the same condition as was intially given to me.

Waiver

• The "borrower" agrees to:
  • Not use any of the borrowed equipment in any completive racing howsoever described
  • Not operate the borrowed equipment under the influence of any drug nor alcohol
  • Provide a copy of a current photo identification card, for example a Drivers Licence
  • Not lend, hire, lease, sublease, nor sell the borrowed equipment to any other person
  • Not allow any other person to operate the borrowed equipment
  • Pay for all costs, charges and fees in relation to this agreement
  • At all times operate the borrowed equipment in a safe and proper manner in accordance with the borrowed equipments designed purpose
  • At all times comply with the provisions of the Road Traffic Act of Queensland, together will all other applicable Government Road Safety Rules and Regulations, howsoever described whilst operating the borrowed equipment
  • At all times keep the borrowed equipment maintained in a safe and secure manner during the borrowing period
  • Return the borrowed equipment to the selectability Bike Shed on or before the expiration of the borrowing period
  • Pay within the time stipulated all fines imposed pursuant to any lawful authority including legislation regulation in relation to the borrowed equipment or the use of the borrowed euqipment during the hire period
  • Borrow and operate the borrowed equipment at his/her own risk at all times under this borrow a bike agreement
  • At all times take full responsibility for all persons under the borrowers legal care, including but not limited to persons under the age of 18 and persons under a guardinaship or similar arrangement.
• The borrower agrees that in the event of damage or breakage to the borrowed equipment to immediately return the borrowed equipment to selectability Bike Shed.
• The borrower acknowledges and agrees that all replacement parts including labour and repair howsoever required shall be at the sole cost of the borrower and must be paid to selectability Bike Shed at the time of return of the borrowed equipment to selectability Bike Shed and upon assessment of the repairs required.
• selectability Bike Shed reserves the right to refuse to hire any hire equipment to any person at its sole discretion.
• selectability Bike Shed does not warrant the suitability nore performance of the borrowed equipment whatsoever.
• The borrower agress that selectrability Bike Shed accepts no responsibility for damanger including bodily injury, death, property damage or losses of any nature sustained by the borrower or any other person whatsoever and howsoever arising out of an incident in relation to the borrowing of the borrowed equipment or any ancillary thereto and the borrower and his/her executions and administrators and assigns expressly renounce all claims against selectability Bike Shed in respect thereof whereby the same may be due to or alleged to be due to any negligence, act, or omission on the part of selectability Bike Shed or not. The borrower hereby releases and indemnifies and holds indemnified selectability Bike Shed and all representatives, employees, suppliers of equipment and owners of premises from all liability and responsibility whatsoever for personal injury, property damage or death howsoever caused including but not limited to the negligence of selectability Bike Shed and its related parties as described above. 

Agreement

By signing and agreeing to the terms and conditions and waiver of this document, you are legally releasing, discharging and indemnifying selectability Bike shed owners, employees and associates from any liability or claim upon the aforementioned for damage/s or looses incurred by myself (or child if under the age of 18 years) against selectability Bike Shed. This includes liability, mishap, accident and/or injury or a personal nature to myself, or property which occurred during the hire period.
